Consumer Review Fairness Act (15 U.S.C. § 45b)

Signed into law on December 14, 2016, the Consumer Review Fairness Act (CRFA) provides sweeping federal protection for consumer speech. Under this law:

Consumers have the federally protected right to share honest reviews of products, services, and business conduct.

This protection extends to written reviews, social media posts, oral statements, uploaded videos, and photographs.

No business may use contracts, threats, or legal action to prevent, restrict, or penalize consumers for posting honest reviews.

Any contract clause that attempts to restrict consumer reviews is void and unenforceable under federal law.

Violations of this Act are enforceable by the Federal Trade Commission (FTC) with penalties of up to $50,000 per violation.

Every consumer story, review, photograph, and video shared through this platform represents the exercise of federally protected rights under the CRFA.

First Amendment Protections

The First Amendment to the United States Constitution guarantees the right to freedom of speech and freedom of the press. Consumer reviews addressing matters of public concern — including the quality, safety, and honesty of commercial services — occupy a position of significant constitutional protection.

Courts have consistently held that consumer commentary about commercial transactions constitutes protected speech, particularly when it serves the public interest by warning others of potential harm or deceptive business practices.

Anti-SLAPP Protections

Strategic Lawsuits Against Public Participation (SLAPP suits) are legal actions filed with the primary purpose of silencing criticism and intimidating consumers into silence. Twenty-eight states and the District of Columbia have enacted anti-SLAPP legislation specifically designed to protect consumer speech from these abusive legal tactics.

Section 230 of the Communications Decency Act

Under 47 U.S.C. § 230, interactive computer services — including websites that host third-party content — are immune from liability for content posted by their users. This platform serves as a host for authentic consumer experiences. The stories, reviews, and documentation shared by community members represent their own genuine experiences and are protected third-party content under Section 230.
